PRIVACY AND COOKIES POLICY OF THE WEB PLATFORM HTTP://PARTYPLAY.CC (EU CITIZENS)

This document, hereafter “Privacy and Cookies Policy”, describes the privacy and cookies policy that applies to the web portal http://partyplay.cc, hereafter “the Web Platform” that affects European Union (EU) citizens in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereafter “GDPR” or “General Data Protection Regulation”).

Party Play Limited Liability Company, hereafter “Party Play”, with tax registration number B76729698, filed in the Commercial Registry of Santa Cruz de Tenerife in Volume 3491, Folio 111, Section 8, Sheet TF-58702, Inscription 1, and located in Road Hermanos Franciscanos de la Cruz Blanca, nº 3, office nº 4, Postal Code 38369 Las Chafiras, San Miguel de Abona, Santa Cruz de Tenerife, Spain, is the owner of this Web Platform available to the users, hereafter “the User” or “the Users”. The email provided for the purposes of this policy is privacy@partyplay.cc

This Privacy and Cookies Policy relates to the type of data we collect from Users, to the way it is collected and to our use, storage and management of this data. The User can access to the data at any moment through the web portal.
1. Web Platform and Party Play Services

The Web Platform provides information about the services that Party Play offers to its users and their legal terms and conditions in accordance with applicable law. These terms and conditions can be consulted through the following link: http://partyplay.cc/terms/.


To that effect, the aforementioned terms and conditions of the service are directly related to this Privacy and Cookies Policy and will be fully applicable provided they are compatible with the policy. Accordingly, if the user of the service is a natural person established within the EU, the application of this policy will prevail in all events.

2. The Users

This Privacy and Cookies Policy is applicable to all the Web Platform users and those having undersigned and/or contracted Party Play services through the downloading of the mobile app via App Store and/or Google Play, which are subject to the terms and conditions that Party Play establishes to these effects.


All Party Play services and products target users who are over fourteen (14). If you are under 14, you are by no means permitted to use the web platform and/or its apps, failing which, we shall take relevant action and cancel the individual’s account and immediately proceed to the deletion of his/her personal information in a secure way and in accordance with applicable law. Given the case, we reserve the right to take legal action to preserve our rights and legitimate interests.


In any event, the data provided by the users who access Party Play services shall be:


  • Sufficient, adjusted, limited and proportional to the legitimate objective of data processing as established and reported by Party Play, which shall ensure the utmost respect for the principles of purpose limitation and data minimization (article 5, paragraph 1, subparagraph b) and c) of GDPR).

  • Accurate, kept out to date and authentic. Party Play shall be entitled to properly verify the user’s identity, capacity and, given the case, the identity of the person acting on his/her behalf, all of which under the principles of data quality, data accuracy and data protection (articles 4 and 9 of the Spanish Organic Law 15/1999 of 13 December on the Protection of Personal Data [Spanish Data Protection Act referred to as LOPD, in its initials in Spanish]; and article 5, paragraph 1, subparagraph d) and f) of GDPR).

We hereby inform that solely registered users will qualify to use the services and functionalities of Party Play, whom shall be held fully liable for the proper use of their user accounts and passwords. Should the user misuse his/her personal accounts and/or passwords, he/she shall be held fully and solely liable for the damages caused and Party Play shall be discharged from any responsibility at this respect.


In the event of suspected compromise of his/her account and/or password, the user shall immediately contact and report the situation or incident to Party Play through the email provided above in this policy, whereupon Party Play shall take appropriate remedial action to address the situation or incident.

3. Duty of information

3.1. In accordance with Spanish regulations on personal data protection, we shall provide you the following information:


  • That Party Play cannot provide its services properly without the provision of the required personal data from the user.

  • That Party Play is responsible of processing your personal data and shall process it. At the top of this policy, you will find its corporate credentials and contact. If you have any inquiry, please, send us an email to privacy@partyplay.cc and we will be delighted to provide you with any further legal information that you might require, if appropriate.

  • That Party Play shall process the user’s personal data to fulfil the purpose of providing the services required and/or contracted by the user to this company, to fully manage the end-to-end service, and the corresponding financial and accounting management, billing, commercial and/or promotional information on the contracted services that may be of interest to the user.

  • That in accordance with the principle of purpose limitation relating to the processing of personal data, the data provided by the user shall be processed solely for the purposes described in this policy and for no other that might be incompatible. Personal data shall be stored during the existence of a legal relationship between the user and Party Play, and shall be preserved, under the secure measures and the time established by law, after the termination of such legal bond and/or for assigning future liabilities that may result from the provision of such services.

  • That in given circumstances pursuant to article 18 of GDPR, the users may request a restriction of data processing, in which case Party Play shall solely preserve the data for the exercise or defence of legal claims.

  • That data processing is legitimate and necessary for the execution and performance of the contract between the user and the company. That both entering a contract and/or downloading the mobile application (app) into the user’s device require the acceptance of the terms and conditions provided in this Web Platform: http://partyplay.cc/terms/. That the acceptance of the aforementioned terms and conditions are also required to provide the services correctly. Accordingly, and in accordance with applicable law, the user acceptance of these terms and conditions entitles and legitimates Party Play for processing his/her personal data.

  • Unless otherwise provided by law, personal data shall not be transferred to third parties.

  • That Party Play does not envisage international transfer of data to third parties. That the users’ personal data shall be hosted in a secure server within the European Economic Area (EEA) and that Party Play shall adopt the appropriate legal measures for the compliance of its processing obligations. In addition, should Party Play contract hosting services to third parties, it shall strictly comply with Spanish regulations on personal data protection and with GDPR on controllers and processors employment.

  • In accordance with GDPR and Spanish regulations on personal data protection, the user, if he/she should so wish, may exercise his/her right to request further information, access, rectify, erase personal data, request restriction of processing concerning his/her data, to object to processing as well as the right to data portability. For this purpose, the user may send a written request to Party Play at privacy@partyplay.cc In accordance with GDPR, we shall inform you that you may submit a complaint to the relevant data protection supervisory authority, should Party Play fail to provide you with a positive feedback during the exercise of your rights. 4. Consent of the individual concerned

By accepting this Privacy and Cookies Policy, the user gives unequivocal consent on personal data processing to enable Party Play properly provide the services subject to the terms and conditions described on this Web Platform and to which the downloading of the mobile application (app) is also subject.


Should the user not accept this policy or personal data processing, Party Play shall reserve the right to prevent the use of this platform, mobile application and related services and functionalities.

5. Security

Pursuant Article 32 of GDPR on Security of processing, taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons, Party Play shall implement appropriate technical and organisational measures to ensure a level of security appropriate to the risk, and regularly test, assess and evaluate the effectiveness of its technical and organisational measures for ensuring the security of the processing of the data that is under its responsibility. Without limiting the foregoing, the user shall be aware that security measures in the Internet are by no means impossible to breach.

6. Obligations of secrecy and confidentialitys

In accordance with applicable law, Party Play shall duly comply with the obligation of professional secrecy and confidentiality in relation to the personal data contained in the files under its responsibility.

7. Cookies policy

In accordance with recital 30 of GDPR, natural persons may be associated with online identifiers provided by their devices, applications, tools and protocols, such as internet protocol addresses, cookie identifiers or other identifiers such as radio frequency identification tags. This may leave traces which, in particular when combined with unique identifiers and other information received by the servers, may be used to create profiles of the natural persons and identify them. Party Play’s cookie policy is hence in line with the existing applicable regulation.


7.1. Applicable law.


In pursuance with article 22 of the Law 34/2002 of 11 July on the Services of the Information Society and Electronic Commerce (LSSICE, in its Spanish initials) referred to the rights of the recipients of electronic commercial communications, once the recipient has previously expressed his/her informed consent, service providers shall ensure the use of electronic communications networks that store and/or gain access to the information stored in the terminal equipment of the recipient.


To this effect, service providers shall ensure that the recipient concerned receives in advance clear and comprehensive information, particularly, about the purpose of the data processing in accordance with the Spanish Organic Law 15/1999 of 13 December on the Protection of Data of Personal Nature.


When technically possible and effective, the recipient’s consent to processing may be expressed by using the appropriate settings of a browser or other application.


This shall not prevent any technical storage or access for the sole purpose of carrying out or facilitating the transmission of a communication over an electronic communications network, or as strictly necessary in order to provide an information society service explicitly requested by the recipient.


In any case, the Spanish applicable legal framework endorses the use of an opt-in system but not the opt-out. This is also stated by the Spanish Agency for Data Protection (AEPD, in its Spanish acronym) in its Legal Report nº 11/2014: “(…) Therefore, the response shall be clearly negative for the (…) system called opt-out, and positive for the (…) system known as opt in. In accordance with the Directive 2009/136/CE and the Royal Decree-Law 13/2012 it shall not be interpreted that an opt-out system shall be advisable. Hence, the exercise of the right of exclusion shall not imply the expression of consent, that is, through the systems put at the user’s disposal in a website to reject the tracking option of the provider. (…)”.


7.2. User consent and cookies: general rule and exception.


As a general rule, the installation and/or use of cookies for data processing purposes shall be subject to prior informed consent of the user, whether proprietary or third-party cookies, session or persistent cookies. Accordingly, the service provider shall duly comply with both obligations: the duty of information and the duty of obtaining the express consent of the user, with exception of the cookies exclusively allowing the connection of the user’s equipment and the net and, strictly, the cookies used to provide a service requested by the user.


For instance, “technical cookies” (cookies that allow the user to browse through a website, platform or application); “customization cookies” (cookies that allow users to access the service with some predefined general characteristics based on the user's terminal settings, such as language, and more); and “security cookies” (cookies that detect repeated and failed attempts to connect to a site).


7.3. Integrated legal policies.


In the light of the foregoing, this cookie policy is complemented and integrated with the terms, warnings, legal and privacy notices of this Web Platform.


7.4. Does the platform generate cookies? What are cookies?


This Web Platform uses cookies, that is, files or devices that are installed in the terminal equipment of the user (personal computer, smartphone, tablet, etc.), regardless of its nature, and with the purpose of storing data that may be kept up-to-date and gained access to by the entity responsible for installing them.


This Web Platform requires cookies for browsing and certain utilities and services, therefore disabling or blocking these cookies may affect the use of the Platform and of such utilities and services.


7.5. What sort of cookies does this platform use?


This Web Platform may work with proprietary and/or third-party cookies. Proprietary cookies are sent or installed into the terminal equipment of the user and processed from the Web Platform (editor). Third-party cookies are sent or installed from other domains or servers not pertaining to this Platform, which are in charge of processing the data gathered through these cookies.


Additionally, the aforementioned cookies may also be session or persistent cookies. Session cookies are designed to collect and store data while the user accesses the Platform to the purpose of processing the information relevant for the provision of the service requested by the user in one single occasion. However, persistent cookies are designed to keep data stored in the terminal that can be accessed and processed over a period of time defined by the cookie's publisher.


There are also technical cookies, which allow the user to browse through the Platform and use the different options or services provided therein for different purposes, such as, for example, controlling traffic and data communication, session login, accessing restricted sections, remembering the elements comprising an order, completing an order's purchasing process, filling out an event's participation or registration form, using security features while browsing, buffering content for video or sound streaming, or sharing content through social networks.


Customization cookies are those cookies that allow users to access the service with some predefined general characteristics based on the user's terminal settings, such as language, type of browser through which the service is accessed, the regional configuration from which the service is accessed, etc.


Analysis cookies are those cookies that allow their publisher to track and analyse the behaviour of the linked websites' users. The information collected through such cookies is used to measure the Platform activity, and to draw-up user platform browsing profiles, in order to implement improvements based on usage data analyses.
